Agiwal Fintech Private Limited, having its registered office at 506, 5th Floor, World Trade Centre, Barakhamba Lane, Connaught Place, New Delhi – 110001 (hereinafter referred to as the “Company,” “We,” “Us,” or “Our”), has developed and solely owns a mobile software application called “AGI Moneey” (the “App,” which term shall include any future enhancements, updates, or releases). The Company makes the App available for download and use by eligible end-users (hereinafter referred to as “User,” “You,” or “Your”), subject to the terms and conditions outlined herein (“Terms”).
The Company also operates a website at https://www.agimoneey.com (the “Website”), which is intended solely for informational and marketing purposes and does not directly offer or process any services. The App and the Website are collectively referred to as the “Platform.”
By accessing, downloading, or using the Platform, You agree to be bound by these Terms. If You do not agree to these Terms, please do not use the Platform. Your continued use of the Platform shall be deemed as Your ongoing acceptance of these Terms, including any modifications or updates made from time to time.
By using the AGI Moneey Platform, You agree to abide by these Terms & Conditions, as well as all other applicable policies of AGI Moneey, including but not limited to the Privacy Policy, which describes how AGI Moneey collects, uses, shares, and stores Your personal information.
You acknowledge that You have read and understood these Terms & Conditions and the Privacy Policy, and that You agree to be bound by them.
AGI Moneey reserves the right, at its sole discretion, to modify, update, amend, or remove any part of these Terms & Conditions at any time. Any such changes will be notified to You through appropriate means. It is Your responsibility to review the updated Terms & Conditions. Continued use of the Platform following any changes shall constitute Your acceptance of the revised Terms.
AGI Moneey also reserves the right to suspend or terminate Your access to the Platform or Your user account if it is brought to Our notice, or if We have reason to believe, that You are not eligible or have violated any provision of these Terms.
These Terms & Conditions constitute an electronic record in accordance with the applicable laws and do not require any physical or digital signatures.
For the purpose of these Terms & Conditions, unless the context otherwise requires:
a) “Employee” refers to an individual employed full-time with a partnered employer, having a fixed salary and eligible to receive Earned Wage Access through the AGI Moneey Platform.
b) “Employer” means any organization or entity that has entered into an agreement with AGI Moneey to enable its Employees to avail Earned Wage Access. The Employer agrees to deduct the disbursed amount from the Employee’s salary and remit the same to the NBFC at the time of salary disbursement.
c) “NBFC” means a Non-Banking Financial Company that has entered into an agreement with AGI Moneey to disburse Earned Wage Access amounts directly to eligible Employees and to collect repayments only through deductions made by the Employer at the time of salary disbursement. No direct repayment is made by Employees to the NBFC.
d) “Earned Wage Access (EWA)” means the facility that allows Employees to access a portion of their accrued and earned wages/salary before the regular payday.
e) “Platform Fee” refers to the nominal convenience or processing fee charged by AGI Moneey for enabling access to EWA services.
f) “Repayment” means the deduction of the Earned Wage Access amount from the Employee’s salary by the Employer and remittance of the same to the NBFC, in accordance with the terms agreed.
g) “HRMS Services” means the Human Resource Management System features currently offered through the AGI Moneey Platform, which include attendance tracking (with geo-location captured only at punch-in and punch-out) and salary tracking.
h) “Website” means www.agimoneey.com, which is solely for informational and marketing purposes and does not itself offer or process any services or transactions.
The AGI Moneey Platform, including all associated products, services, features, and technologies (collectively, the "Platform"), is made available to you solely for use in accordance with these Terms and Conditions ("Terms").
By accessing or using the Platform, you agree to be bound by these Terms, which form a legally binding agreement between you and Agiwal Fintech Private Limited, a company incorporated under the laws of India and having its registered office at 506, 5th Floor, World Trade Centre, Barakhamba Lane, Connaught Place, New Delhi – 110001 ("AGI Moneey", "we", "our", or "us").
This Platform is licensed, not sold, to you for personal and lawful use only. The license is non-exclusive, non-transferable, and limited to the scope of access granted herein.
If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.
To access and use the AGI Moneey Platform, you are required to create an account (“Account”). The onboarding process is initiated through your registered mobile number as provided by your Employer to AGI Moneey at the time of signing the service agreement.
When you first log in, you will be prompted to verify your mobile number through a one-time password (OTP). Upon successful login, you will be asked to review and validate pre-filled personal and employment details that have been shared by your Employer.
These may include:
• Full Name
• PAN
• Aadhaar Number
• Bank Account Details
• Official Email Address
• Mobile Number
These details are already available with AGI Moneey through your Employer and are displayed for confirmation purposes. You are responsible for verifying the accuracy of this information during the onboarding process. Any discrepancies must be immediately brought to the attention of your Employer and AGI Moneey for rectification.
You are solely responsible for maintaining the confidentiality of your login credentials and ensuring that access to your mobile device is secure. AGI Moneey will not be responsible for any unauthorized use of your Account resulting from loss or misuse of your mobile device.
AGI Moneey reserves the right to suspend or terminate any Account found to contain false, misleading, or unverifiable information or found to be engaged in suspicious or fraudulent activity.
By accessing or using the AGI Moneey Platform, you explicitly agree, represent, and warrant that:
a) You are at least 18 years of age, legally competent to enter into binding contracts under the Indian Contract Act, 1872, and not otherwise disqualified from contracting under applicable laws.
b) You are a resident of India and hold a valid Indian bank account.
c) You are currently employed with an organization that has executed a valid agreement with AGI Moneey to offer Earned Wage Access and/or HRMS services to its employees.
d) You have successfully completed the Know Your Customer (KYC) verification process as mandated by applicable laws.
e) You shall not give access to or share your AGI Moneey account credentials with any third party, nor transfer your account to another person.
f) You shall only use the Platform in accordance with these Terms and Conditions and all applicable laws, regulations, and court orders.
g) You have not been previously suspended or disqualified from using AGI Moneey for violations of its Terms or any applicable law.
h) You further agree, undertake, and covenant that while using the Platform:
• You shall not engage in any unlawful, misleading, discriminatory, or fraudulent activity.
• You shall not upload or transmit viruses, malware, or any other harmful code or content.
• You shall not access or collect data from the Platform using automated means, or attempt to access content or information you do not have permission to access.
• You shall not interfere with, disrupt, disable, or impair the proper working of the Platform or its security features.
• You shall not engage in activities such as spamming, phishing, unsolicited communications, or unauthorized advertising or promotion.
You are solely responsible for maintaining the confidentiality of your account, including your login credentials and any device access. You must promptly notify AGI Moneey of any unauthorized access or security breach. AGI Moneey reserves the right to suspend or terminate any account found to be involved in fraudulent, illegal, or unauthorized activity, or in breach of these Terms.
To avail the Earned Wage Access (EWA) facility offered via the AGI Moneey platform, you must first complete the following steps:
a) Upon being onboarded by your Employer, you are required to sign up on the AGI Moneey mobile application using your registered mobile number (as provided by the Employer).
b) After verifying your mobile number through a one-time password (OTP), you must create a secure 4-digit PIN, which will be used for all future logins and authorizations on the AGI Moneey platform.
c) You are solely responsible for maintaining the confidentiality of this PIN and any activity that occurs under your account. If you suspect unauthorized access, you must immediately report it to AGI Moneey.
a) AGI Moneey enables Earned Wage Access only upon approval by the Employer using either of the following two models:
a) The Employer may pre-authorize a fixed percentage or amount of accrued wages/salary available for withdrawal by each employee.
b) This pre-approved EWA limit is defined and managed through the Employer's web-based AGI Moneey dashboard and can be amended at any time.
a) Alternatively, the Employer may require that each EWA request initiated by the employee be individually reviewed and approved.
b) In such cases, every withdrawal request will trigger a notification to the Employer, and will be processed only upon explicit approval by the Employer via the dashboard.
a) Once approved by the Employer, the EWA request is forwarded to the partnered NBFC for final processing and disbursal to your verified bank account.
b) All disbursals are subject to applicable Know Your Customer (KYC) and internal due diligence procedures.
c) You irrevocably authorize your Employer to deduct the EWA amount and platform fee from your salary and remit the same directly to the NBFC’s repayment account at the time of salary disbursement.
d) You are not required to make direct repayment to AGI Moneey or the NBFC.
a) The EWA amount disbursed to you shall not exceed your earned and unpaid wages as confirmed by the Employer.
b) The balance available for withdrawal is dynamic and updated based on attendance and salary records integrated via the AGI Moneey platform or Employer-approved systems.
c) All services are governed by the Terms & Conditions, Privacy Policy, and any other agreements executed as part of your onboarding process.
AGI Moneey may charge a platform fee for enabling and processing the Earned Wage Access transactions. This fee will be disclosed transparently within the App before you confirm your EWA request. The platform fee is deducted at the time of disbursement and is non-refundable once the transaction is successfully processed. AGI Moneey reserves the right to revise the platform fee from time to time, with prior intimation to users.
AGI Moneey may also offer limited Human Resource Management System (HRMS) features, such as:
AGI Moneey values your privacy and is committed to protecting your personal information. All data collected via the Platform, including but not limited to KYC documents, employment details, salary, bank account, PAN, Aadhaar, and mobile number, is handled in accordance with our Privacy Policy.
By using the Platform, you consent to the collection, storage, use, and sharing of your data as described in the Privacy Policy.
Your information may be shared with Employers, NBFCs, and authorized third parties solely for the purpose of enabling the services on the Platform, KYC compliance, and regulatory obligations.
All content, trademarks, service marks, logos, and intellectual property on the AGI Moneey Platform, including the App and Website, are the sole property of Agiwal Fintech Private Limited.
Users are not permitted to copy, reproduce, republish, upload, post, transmit, or distribute any material from the Platform in any form without prior written permission. Any unauthorized use of the intellectual property may result in legal action.
To the maximum extent permitted under applicable law, AGI Moneey, its affiliates, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising out of or in any way connected with your access to or use of the Platform, including but not limited to:
AGI Moneey reserves the right to suspend, disable, or terminate your access to the Platform or any part thereof, at its sole discretion, with or without prior notice, including but not limited to cases of:
Upon termination, your rights to use the Platform will cease immediately, but your obligations related to prior EWA transactions shall continue.
In the event of any disputes, differences, or claims arising out of or in connection with the Terms or use of the Platform, the parties shall first attempt to resolve the matter amicably through written communications.
If not resolved within 30 days, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall be conducted in English and seated in New Delhi. The decision of the arbitrator shall be final and binding.
These Terms and any disputes arising out of or in relation to them shall be governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, the courts at New Delhi shall have exclusive jurisdiction.
